Platform Overview

GAISHA provides aquaculture operational intelligence through software, analytics, sensor integrations, dashboards, and AI-assisted features designed to help farms monitor conditions, organise operations, and support decision-making.

Features may vary by plan, deployment stage, geography, and programme participation. Some capabilities are offered in beta, pilot, or preview form and may change over time.

Acceptable Use

You agree to use GAISHA lawfully and responsibly. You must not:

• Access accounts, data, or systems without proper authorisation.
• Interfere with platform security, stability, or other users’ access.
• Upload malicious code, attempt unauthorised scraping, or reverse engineer restricted components except where permitted by law.
• Use GAISHA outputs to misrepresent farm performance, evade regulatory obligations, or harm people, property, or the environment.
• Resell, sublicense, or commercially exploit GAISHA except as expressly permitted in writing.

Farm Data Ownership

You retain ownership and control of operational data you submit or connect to GAISHA, subject to the licence needed for us to host, process, back up, display, and analyse that data to provide the services you use.

You are responsible for ensuring you have the right to provide farm, employee, and third-party data to GAISHA.

AI & Advisory Disclaimer

GAISHA may generate insights, alerts, summaries, forecasts, or recommendations using artificial intelligence and operational analytics. These outputs are advisory and informational in nature.

AI features may be experimental, incomplete, or unsuitable for every farm environment. You remain responsible for evaluating outputs and making final operational, financial, biological, and regulatory decisions.

GAISHA does not replace professional judgment, veterinary advice, statutory compliance obligations, or on-site farm management.

No Guaranteed Farming Outcomes

GAISHA aims to improve visibility, efficiency, and decision support, but we do not guarantee specific production results, survival rates, feed conversion outcomes, disease prevention, profitability, or regulatory compliance.

Aquaculture involves biological, environmental, and market variables outside our control. Platform use is at your own operational risk.

Accounts & Security

You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly if you suspect unauthorised access.

We may suspend or restrict accounts that violate these terms or create security, legal, or operational risk.

Subscriptions & Payments

Paid plans, pilot programmes, subsidies, and lab support offerings may be subject to separate order forms, pricing pages, invoices, or programme terms.

Fees, billing cycles, renewal terms, and refund conditions will be stated at the point of purchase or in applicable programme documentation. Failure to pay may result in suspension of access.

Intellectual Property

GAISHA, including its software, branding, interfaces, documentation, models, and underlying technology, is owned by or licensed to GAISHA Sdn Bhd and protected by applicable intellectual property laws.

These terms do not transfer ownership of GAISHA platform IP to you. You receive a limited, non-exclusive right to use the services according to your plan and these terms.

Future Feature Changes

GAISHA is an evolving aquaculture intelligence platform. We may add, modify, suspend, or retire features, integrations, AI models, dashboards, or programme offerings as the product develops.

We will use reasonable efforts to communicate material changes that affect paid services, but continued use after updates constitutes acceptance of revised terms where permitted by law.

Limitation of Liability

To the fullest extent permitted by Malaysian law, GAISHA and its directors, employees, contractors, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, production, data, or business opportunity arising from use of the platform.

Our total liability for any claim relating to the services shall not exceed the fees paid by you to GAISHA for the services giving rise to the claim during the twelve (12) months preceding the event, unless a higher amount is required by applicable law.

Termination

You may stop using GAISHA at any time. We may suspend or terminate access if you breach these terms, fail to pay applicable fees, or if continued service becomes impractical for legal, security, or operational reasons.

Upon termination, your right to access the platform ends, subject to any data export or retention obligations stated in your agreement or applicable law.

Governing Law

These Terms of Use are governed by the laws of Malaysia. Any dispute arising out of or in connection with GAISHA shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless mandatory law requires otherwise.
